REQUEST FOR ADDITIONAL PUBLIC COMMENT ON NOTICE OF INQUIRY
(66 FR 64783)

The Recording Industry of America, Inc. (RIAA), the National
Music Publishers Association, Inc. (NMPA), and The Harry Fox
Agency, Inc. (HFA), have submitted a joint statement to the
Copyright Office to advise the Office of certain
developments relevant to the Copyright Office's Notice of
Inquiry regarding the interpretation and application of the
mechanical and digital phonorecord compulsory license, 17
U.S.C. 115, to certain digital music services. (See NewsNet
116, March 9, 2001; 66 FR 14099.) Specifically, RIAA, NMPA,
and HFA have advised the Office that they have entered into
an agreement concerning the mechanical licensing of musical
works for new subscription services.  The Copyright Office
requests additional public comment on its Notice of Inquiry
in light of the RIAA/NMPA/HFA agreement filed in this
proceeding. The joint statement and the accompanying
exhibits (including a copy of the agreement) are posted on
the Office Website at:

Comments are due January 28, 2002, and reply comments are
due February 27, 2002.

Phase I distribution proceeding with Phase I distribution

January 1, 2002: Effective date of cost of living adjustment
in the royalty rates paid by colleges, universities, or
other nonprofit educational institutions that are not
affiliated with National Public Radio for the use of
copyrighted published nondramatic musical compositions (66 FR
59698)

January 3, 2002: Due date for comments on interim
regulations on disruption or suspension of postal or other
transportation or communications services (66 FR 62942)

January 22, 2002: Due date for reply comments on
consolidation of rate adjustment proceeding to determine
reasonable rates and terms for the public performance of
sound recordings by new subscription services with a similar
proceeding for preexisting satellite digital audio radio
services and preexisting subscription services (66 FR 58180)

January 28, 2002: Due date for additional comments on the
effect of the RIAA/NMPA/HFA agreement on the issues
identified in the March 9, 2001, Notice of Inquiry (66 FR
64783)

February 20, 2002: Close of arbitration proceeding to set
the rates and terms for the digital public performance of
sound recordings license as it pertains to webcasters under
17 U.S.C. 114 and for the making of ephemeral copies in
furtherance of a digital public performance under 17
U.S.C.112 (66 FR 38324)

February 27, 2002: Due date for additional reply comments on
the effect of the RIAA/NMPA/HFA agreement on the issues
identified in the March 9, 2001, Notice of Inquiry (66 FR
64783)
