A few observations.

In the scan response example, I think terms and term need to be lower
case (rather than Term).

Also, I think, the diagnostic should be in a 

<srw:diagnostics>
  <diag:diagnostic>

structure rather than a records structure (which only applies to
surrograte diagnostics which aren't applicable in scan)
