Thus far the Beatles have not agreed to it. In many cases record labels don't have the right to sell music in any manner outside the terms of the artist's recording contract.

This was why it took so long for legal music file sales to begin. Forcing artists like the Beatles to go along with selling files is why the internet industry is hell-bent on getting compulsory licensing for digital media legislated. It's all about taking negotiating power away from recording artists.
