There are at least three different reply options available on some/many
email programs:
Reply
Reply to All
Reply to List
Thunderbird, for example, has options for and the ability to use all
three. However, very few of the mailing lists I subscribe to properly
use the Reply to List function.
Thunderbird looks for a List-Post header (lacking in ARSCLIST) and then
the Reply To List button becomes visible.
David Burnham, Joe Salerno, and others are within their rights to place
their email address in the Reply-To field.

The harmful aspect, as I read it, is when a mail list modifies the
Reply-To header, not the sender/author using it which is what it is
designed for.
Ideally, all lists would use the List-Post header and all email clients
would have the Reply-To-List button enabled. So far, that doesn't seem
like it is going to happen.
A suggested work-around--and what I do in these cases is to Reply All,
delete the individual's name and let it go. My recent reply to David
Burnham got caught in this as I didn't look at the header and see my
first attempt went only to him.
Nothing is wrong as far as the rules are concerned, really. However, the
one change I would suggest is that the List-Post header should be added
to all ARSCList list messages directing to the posting address. In that
way, those who have access to the Reply-to-List button could then use it.
