I consider it a bug in the current schema to allow nilled queries, that is
being fixed in 1.1 rather than errata for 1.0.
But that said, I agree with Jannifer's logic below about the stage at
which it's being caught resulting in the different fault handling.
Will update my server to do this now (as it was prompted by Theo sending
?query= to it and logging the fault)
