the <accessCondition> element in MODS is extensible with other schemas (see example here: http://www.loc.gov/standards/mods/userguide/accesscondition.html) and looking through the NISO documentation it seems that a namespace has been declared to facilitate the use of the <free_to_read> and <license_ref> elements in existing schemas. Would this approach accommodate your implementation?
